Terms of Use<\/h4>\r\nPlease pay special attention to the following terms before using the services of MDE (the Company). By registering as a user (the Client) and using the Company\u2019s services, you agree to be bound by these terms. In the event of any inconsistency between these Terms of Use and the General Conditions of the Services provided, the General Conditions of the Services shall prevail.\r\n\r\nANY INDIVIDUAL WHO DOES NOT ACCEPT THESE TERMS AND CONDITIONS OF USE, WHICH ARE MANDATORY AND BINDING, MUST REFRAIN FROM USING THE SITE AND\/OR THE SERVICES.\r\n\r\n<h4>2. Service<\/h4>\r\nThe Company provides the Client with a physical address in Barcelona or another geographic location in Europe for use as a mailing address to receive online purchases, correspondence, or goods. The Company will receive, verify, store, and deliver the package wherever the client indicates. The Client may also contract optional extra services while the package is stored in the warehouse.\r\n\r\nAt the postal address assigned by the Company, the Client may receive orders, mail, documents, and\/or merchandise. The Company is not responsible for the package contents, which must be declared by the Client. After receiving a package, it will be verified by measuring, weighing, opening it, and taking photographs of its contents solely so that the Client can confirm the correctness of its content and so the Company can rule out any prohibited items.\r\n\r\nAll acquisition and shipping costs from the seller to the warehouse are the Client\u2019s responsibility. The Company may provide additional services beyond those described here, such as repackaging, pickups, consolidations, or any other services related to the packages. These will be quoted separately and must be pre-approved by the Client.\r\n\r\n<h6>2.0 Memberships<\/h6>\r\nOur memberships at MDE are designed to offer flexibility and convenience for handling your packages and international shipments. We offer two types of memberships: monthly and annual.\r\n\r\nBy subscribing to any of our memberships, you agree to pay the corresponding renewal fees once the initial period has ended. This system ensures uninterrupted service, providing you with the ongoing convenience of our assistance.\r\n\r\nWe want you to have full control over your membership. Therefore, you are free at any time to cancel immediately from your profile, allowing you to manage your subscription according to your needs. At MDE, we strive to provide an adaptable and transparent service that meets your individual preferences.\r\n\r\n<h6>2.1 User Registration<\/h6>\r\nYou must complete the registration form accurately in all its fields with valid data to use the Company\u2019s services. The Client must fill it out with correct, precise, and true personal information (\u201cPersonal Data\u201d) and select a membership type, paying the corresponding fee. To complete account activation, the user must upload an image of a valid ID (such as a DNI or Passport) so the Company can verify their identity and then activate the user\u2019s account. When the Client registers, the Company will provide them with a personal, non-transferable postal address in Europe. The accuracy and correctness of the personal data associated with the account, as well as its security, are the Client\u2019s responsibility. The Client is responsible for all transactions made under their name, as access to the same account is restricted and the user\/password is known only to the Client. The Client agrees to immediately notify the Company of any unauthorized use of their account or any unauthorized access by third parties.\r\n\r\nThe Client must have a valid email address for all communications with the Company. The Company\u2019s service is offered only to individuals at least 18 years old.\r\n\r\n<h6>2.2 Creating a New Package<\/h6>\r\nAfter making a purchase, the Client must log in to their account and create a new package, thus notifying the Company that a new shipment is arriving. They must provide the required information and attach a copy of the commercial invoice\/receipt for the purchase.\r\n\r\nIf, upon arrival of the package at the Company\u2019s warehouse, it does not have a matching entry in the system, including the value declaration, the client must take the necessary steps to add it. Without this documentation, shipments cannot be removed from the warehouse.\r\n\r\nThe Company is only responsible for receiving, handling, storing, and any extra services hired by the Client, as well as delivering the package as instructed. Declaration of the contents and value of the shipments is the Client\u2019s responsibility, not the Company\u2019s.\r\n\r\n<h6>2.3 Receiving Packages<\/h6>\r\nThe Company will only accept shipments correctly addressed to the assigned address, i.e., with the Client\u2019s name and username. They must also include the corresponding purchase or value invoice. Any shipments received without being able to identify the corresponding Client will remain in the Company\u2019s possession for up to 15 days. Once this time has passed without identifying the owner, the Company becomes the new owner of the package and its contents, and the Client has no right to claim.\r\n\r\nThe Company will not pay any amount requested by cash-on-delivery for shipments directed to the assigned warehouse address included with the service. Such a requirement is grounds for rejecting those shipments, without incurring any liability for the Company.\r\n\r\nThe Client may receive any item at the address in Barcelona, except those that are prohibited to send or receive. Prohibited items include illegal materials such as narcotics, explosives, or other dangerous materials, as well as liquids, jewelry, money and\/or bearer instruments, among others. Generally, the Company will not receive, process, ship, or transport \u201cRestricted Goods\u201d or \u201cProhibited Merchandise\u201d classified as such by the <a href=\"http:\/\/www.iata.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">I.A.T.A. (International Air Transport Association)<\/a> or other competent organizations in Spain or in any country of transit.\r\n\r\n<h6>2.4 Check-in of Packages and Verification<\/h6>\r\nThe Company reserves the right\u2014and the Client expressly authorizes it\u2014to inspect what is received at the warehouse, opening packages and verifying contents to check their condition and nature.\r\n\r\nThe Company may photograph or film the contents or obtain another type of record. The Company is not liable for any shipment received with defects, incorrect items, or missing information. Under no circumstances shall the Company be held responsible for deficiencies affecting the usability or essential purpose of the transported product, recognizing that it is not the product\u2019s provider, nor for the quality, quantity, or condition of received items.\r\n\r\nShipments are processed within about 2 working days from arrival at the warehouse, provided all required documentation meets legal and customs requirements, the conditions set forth in this document are met, and the credit card is valid.\r\n\r\n<h6>2.5 Storage<\/h6>\r\nEach package is stored for a finite, specified duration, and the client must pay the storage fee as per their chosen plan. Each membership may include a certain number of free storage days, after which a per-day-per-package fee applies.\r\n\r\nShipments held in the warehouse due to non-compliance with regulations or because of consolidation will remain there waiting for new instructions from the Client. Starting on day 15, additional storage and handling fees will apply, borne by the Client.\r\n\r\nAll shipments are stored in the warehouse for a maximum of 90 days from the Check-In date. After 3 months, the package is declared abandoned, and it may be disposed of or destroyed. No claims of any kind are accepted from the sender or recipients. The Client who has made no claim about said package is automatically placed in \u201cabandoned\u201d status, and the package is at the disposal of the Company.\r\n\r\n<h6>2.6 Shipment Consolidation<\/h6>\r\nMultiple Client shipments arriving at the warehouse can be consolidated. Consolidation is considered an extra service requiring a separate quote, as the price depends on the packages\u2019 characteristics (dimensions, weight, and content). Some items, e.g., fragile goods, cannot be combined with heavy items. Consolidation requires more processing time because a new resulting package is created referencing the originals, and the process merges two or more shipments into one. By using the consolidation service, the Client acknowledges that the final weight of the shipment may vary due to additional packaging required to combine one or more purchases into one or several packages. Individual packages created by the Client for inbound shipment will appear in the next dispatch with a different package number, which can be viewed at any time in the client\u2019s account. To use the consolidation service, the Client may request it by contacting support from their account.\r\n\r\n<h6>2.7 Returns<\/h6>\r\nPurchases the Client makes in online stores are an agreement between the store and the Client. Under no circumstances is the Company an intermediary between the two.\r\n\r\nIf the Client wishes to return the order to the store from the warehouse, they may do so at their own cost, and they must handle all related communications with the seller. The Company will charge a return service fee according to the current rate schedule associated with the chosen plan.\r\n\r\n<h6>2.8 Delivery to Destination<\/h6>\r\nThe Company is not responsible for any damage the shipment contents may suffer.\r\n\r\nIf the merchandise is at risk of breakage due to its original packaging, it must be repackaged to travel. The cost of this service is billed as an additional fee beyond the package delivery cost.\r\n\r\nFor fragile shipments, we recommend adding extra appropriate packaging service.\r\n\r\nThe Company is not liable for loss or damage resulting from natural disasters, acts of terrorism, war-related risks, labor strikes, or civil disturbances. If any of the above events occur while the shipment is still at the warehouse, coverage is provided and a refund is made for the item\u2019s value but not for any internal shipping costs. Once the package has completed Check-In and meets all documentation requirements, <strong>the package is automatically insured for 100% of its value<\/strong> until the package\u2019s Check-Out. Shipping insurance may be contracted as an additional service.\r\n\r\nFor shipments cleared by the <a href=\"https:\/\/www.aduanas.gub.uy\/\" target=\"_blank\" rel=\"noopener noreferrer\">Direcci\u00f3n Nacional de Aduanas (DNA)<\/a> but later rejected by the Client or if delivery to the stated address cannot be made after notice and 30 (thirty) days have passed, the Client grants consent that this shipment is placed at the disposal of the Company. The Company may dispose of it as deemed appropriate, with no claim from the Client.\r\n\r\nIf the client rejects the shipment held by the DNA, they must still pay the Company for the service costs of that package.\r\n\r\nThe Company or its representative in each country will attempt to deliver the merchandise to the final destination, as determined by the Client. If home delivery fails on the first attempt, a delivery notice will be left informing the Client of the attempt and providing details to schedule a new delivery date.\r\n\r\n<h4>3. Regarding the Customs Authorities in Each Country<\/h4>\r\nThe Company is not responsible for customs regulations or provisions in each country, nor for changes in fees applied at the time of entry into the destination country. Shipping cost estimates provided on our website are references only, based on the current regulations and provisions of each country\u2019s customs and other entities.\r\n\r\nAll shipments may be detained by the corresponding customs authority for verification. The Company is not responsible for any expenses incurred by seized shipments. The Client must handle any needed permits required by customs. If a shipment is held, the Company will notify the Client via email. The Client may opt for an additional customs broker service, for which they must pay upfront to proceed with the relevant clearance.\r\n\r\n<h4>4. Responsibilities<\/h4>\r\nThe Client releases the Company from all liability for delays in receiving shipments caused by late arrival at the warehouse, as well as for delays and other failures caused by air and ground transport lines.\r\n\r\nThe Client acknowledges that the Company is not liable for any claims arising from the receipt, handling, consolidation, and\/or shipping of mail, unless proven that an employee of the Company acted fraudulently or negligently.\r\n\r\nThe Client declares understanding of the international postal regulations of the country where the final delivery of the package will take place.\r\n\r\nThe Company is not responsible for ensuring the Client\u2019s compliance with regulations beyond any advice provided. The Client acknowledges that the commercial and operational conditions, as well as the Terms and Conditions of the Company\u2019s services, may be changed by the Company. It is the Client\u2019s exclusive responsibility to check the service conditions in effect at the time each shipment is generated.\r\n\r\nUnder <a href=\"https:\/\/ec.europa.eu\/info\/files\/regulation-eu-2016-679-protection-natural-persons-regard-processing-personal-data-and-free-movement-such-data_es\">Regulation (EU) 2016\/679<\/a>, the Client expressly consents that the data provided from the date of acceptance of these \u201cTerms and Conditions\u201d will be included in the Company\u2019s database for purposes of delivering the services described herein.\r\n\r\nThe Client unequivocally consents to the possible international transfer of personal data, given the intended purpose of this agreement. The Client also declares that such data transfer is necessary to carry out the services set forth in these \u201cTerms and Conditions.\u201d\r\n\r\n<h4>5. Payments and Costs<\/h4>\r\nThe prices shown on the Website are final, in Euros (\u20ac), and include taxes, unless otherwise required by law (particularly concerning VAT). Prices may change at any time.\r\n\r\nThe Client authorizes the Company to charge shipping fees in advance to their credit card, according to the established rates. Likewise, the Client authorizes the Company, via this same method, to collect incidental direct and indirect charges related to purchase handling, such as customs duties, VAT, customs brokerage, storage, special handling, repackaging, volumetric weight surcharges, and any other charge generated by the shipment of merchandise.\r\n\r\nShipping rates are those in effect on the date of final delivery. All shipments are subject to volumetric weight charges (if volume weight is greater than actual weight), calculated as follows: (Length x Width x Height) \/ 6,000 for measurements in centimeters, and (Length x Width x Height) \/ 366 for measurements in inches. Freight rates may be modified if international freight costs fluctuate.\r\n\r\nThe posted rates on each country\u2019s pages are subject to change without prior notice.\r\n\r\n<h4>6. Electronic Communications<\/h4>\r\nEvery time you use the Company\u2019s services or send us an email, text message (SMS), or other communications from your computer or mobile device, you are communicating with us electronically. We will contact you electronically via email, text message (SMS), in-app notifications, or posting messages\/emails on the website. For the purposes of this agreement, you consent to receive communications from us electronically, and you agree that all contracts, notices, and other communications we provide electronically satisfy any requirement that such communications be in writing.\r\n\r\n<h4>7. Jurisdiction and Applicable Law<\/h4>\r\nFor all matters or disputes that may arise from the services provided by the Company, the courts of the city of Barcelona, Spain, shall have jurisdiction. Use of the Company\u2019s services is interpreted as acceptance of these Terms and Conditions.\r\n\r\n<h4>8. Privacy<\/h4>\r\nTo use the services offered by the Company, users must provide certain personal information. That information will be handled according to our Privacy Policies, available on the Company\u2019s website.\r\n\r\n<h4>9. Links to Third-Party Websites<\/h4>\r\nThe Company is responsible for all content on this website. However, this website may contain links to sites operated by third parties. The Company does not assume responsibility for, nor endorse, the content, policies, or use of those third-party websites. Links to websites of other entities are provided solely for user convenience; using third-party sites linked from the Company site is at the user\u2019s own risk.\r\n\r\n<h4>10. Intellectual Property<\/h4>\r\nAll content on the pages related to the Company\u2019s services, including programs, databases, networks, and files enabling the user to access and use their Account, is owned by the Company and protected by international copyright, trademarks, patents, and industrial design laws. Unauthorized use or partial or total reproduction of that content is prohibited unless authorized explicitly in writing by the Company. The presence of links to other websites does not imply any partnership, relationship, approval, or endorsement by the Company of those sites and their content.\r\n\r\n<h4><b>11. Entire Agreement<\/b><\/h4>\r\nThese Terms and Conditions, together with any document explicitly referenced, constitute the entire agreement between the Client and the Company regarding the purchase agreement, replacing any prior verbal or written agreement, arrangement, or promise between the same parties.\r\n\r\nThe User and the Company acknowledge having agreed to a contract without relying on any statement or promise made by the other party, except for what is explicitly mentioned in these Conditions.\r\n\r\n<h4><b>12. Complaints and Claims<\/b><\/h4>\r\n<div>The User may send any complaints, claims, or comments to the Company using the contact information provided at the beginning of these Conditions (General Information).\r\nAdditionally, the Company has official complaint forms available to consumers and users, which they may request at any time using the contact information provided at the beginning of these Conditions (General Information). Furthermore, if a dispute arises from the purchase agreement between the Company and the Client, the User, as a consumer, can request an out-of-court settlement of the dispute under EU Regulation No. 524\/2013 of the European Parliament and of the Council of May 21, 2013, on online dispute resolution for consumer disputes.
